Gunfire's 50k likes contest terms and regulations

Rules of the competition

 

§1 General provisions

1. The Organizer of the competition for the fanpage found under the web address https://www.facebook.com/ASG.Gunfire is SportVentureS, ul. Lekcyjna 96, 51-169 Wroclaw, VAT number: 895-180-76-86, located at: ul. Jana Dlugosza 42-46, 51-162 Wrocław.

2. Facebook is not responsible for the proper conduct of the contest. any claims relating to the competition should be addressed solely to the Organizer of the competition.

3. The founder and sponsor of all the awards in the competition is the above mentioned Organizer.

4. The competition is being organized and conducted exclusively via the Facebook Internet portal and is utilizing a specifically designed competition application located on the Gunfire Facebook profile (hereinafter referred to as "Application").

5. Participation in the competition is free of any charge.

6. The competition runs from 22/08/2014 12:00 until 04/09/2014 23:59 (all dates and times CET). In exceptional circumstances the Organizer of the competition may decide to either extend the duration time or terminate the competition in the self-determined range. This must be followed by a general information made available to all the participants of the competition by uploading it onto the fanpage indicated in § 1 point 1 of the Regulations.

 

§2 Participants [voting and commenting]

1. The participants of the compatiton may be any private persons being a resident of any country within the European Union, of legal age in their country of residue and having full legal capacity, as well as those who are not of legal age or do not have full legal capacity for other reasons, which may participate in the competition with the consent of their legal representatives in accordance with the provisions of the Civil Code, with only one real personal account on Facebook, adhering to the Rules of Facebook located at https://www.facebook.com/legal/terms.

2. The base requirement for the participation in the contest is having the status of a Gunfire fan on his Facebook profile, as well as giving the application permission to access the information provided on the participant's profile on Facebook and acceptance of the provisions of the competition's terms and regulations.

3. By entering the contest, the participant consents to the processing of personal data (first name, last name IP address, e-mail address, gender, age) for the needs of the competition as well as to distribution of the content of the entry on the Gunfire fanpage.

4. By entering the Contest, the Participant confirms the following within the Application:

a) that he accept the provisions of the Regulations and consents to the processing of data in all manners as specified within the Competition terms and regulations.

b) that he releases Facebook from any liability related to the contest.

5. All members (both voting and commenting) who decide to place their votes and comments within the competition Application state that: 

a) they fulfill the conditions set out in § 5. 1, 

b) accept the Terms and Conditions and agree to the processing of personal information 

(first name, last name, IP address, e-mail address, gender, age) for the implementation of the competition as well as for verification of the authenticity of the data. 

6. Voters have the right to cast one vote per day on any designated contenst entry they wish. It is allowed to vote for more than one entry.

 

§3 Rules of the Competition

1. To participate in the competition, one must use the application located at: https://www.facebook.com/ASG.Gunfire/app_479613008784205 

2. Every competition participant must be a fan of Gunfire's Facebook profile and complete the application form by uploading a self-made airsoft demotivator. All demotivators must be made with use of of graphics/photos provided by the Organizer by choosing an appropriate graphic/photo and filling both text boxes. Confirmation of acceptance of the Rules of the Competition is also necessary. A full set of all these elements is further called a Submission. 

3. Each participant is entitled to submit up to three works. 

4. The jury will be choosing from among 30 works with the most "like" votes from among all the works which have surpassed the 60 vote threshold.

5. The Competition is being conducted as follows: 

       a)    from 22/08/2014 12:00 to 29/08/2014 23:59 CET - participants can send Submissions 

       b)    01/09/2014 08:00 to 05/09/2014 16:00 CET - the jury deliberates to determine the winners, 

       c)    not later than 12.09.2014 16:00 CET – competition results will be published.

       6.    The Organizer will contact each of the winners by e-mail, sending a message to the address given 

              in the aforementioned Application.

 

§4 The prize

1. The prize in the Competiotion is a Specna Arms SA-A03 airsoft gun replica.

2.  The jury (consisting of the Organizer's employee's) will be taking under consideration:

a) the adherence of the Submission with the theme of the competition, 

b) the originality and creativity of the Submission

3. The Recipient is obligated to immediately reply to a message sent by e-mail, and provide personal data necessary for the shipping of the prize. Failure by the winner to provide the necessary personal data referred to above within 7 days from the date of receipt of the message from the Organizer by the winner is considered as giving up the right to the award and will void any claims in this respect against the Organizer.

4. In the case of the Winner being a minor or a person who does not have full legal capacity, the consent of the legal representative on the part of the Winner in competition and receiving his prize must be delivered in writing to the address of the Organizer within 7 days from the date of receipt by the Winner the message mentioned above.

5. Prizes will be sent to the address as indicated by Winner and delivered by a courier forwarding company.

6. The prize from the designated poll of awards for the first place in the Competition cannot be exchanged for a different prize nor for a cash equivalent.

 

§5 Copyright and other 

1. By entering the competition, the participants confirms that he is the author with full rights to the material submissioned within the Application, as well as that the materials within the Submission do not infringe the rights of third parties. 

2. The Organizer reserves the right to verify user accounts, work, votes and comments as well as to remove any of them for any reason. § 5. 3 shall apply accordingly. 

3. In case of a reasonable suspicion of fraud, infringement of copyright or other rights of third parties as well as in case of other violations of the Rules and Regulations, the Organizer may decide to disqualify any entries or Submissions uploaded within the Application for Competition terms. Suspected violations should be reported to the address: facebook.com/ASG.Gunfire or at marketing@gunfire.pl. 

4. In special cases, the Organizer reserves the right to cancel the competition.

 

§6 Complaints and final provisions

1. Complaints about the competition can only be made in writing, under the pain of nullity, by registered letter with a clear postmarked address. Complaints mut be sent to the Organizer's address with the annotation "complaint" within 14 days from the occurrence of the base for the complaint, but not later than on 29.09.2014. Complaints received after this time will not be taken under consideration. 

2. The Organizer considers all complaints stated under these Regulations within 7 days from the date of receipt of the complaint. The organizer may require additional statements from the user in order to analyze the basis of the complaint and prove it as valid or invalid.

3.  Any decisions of the Organizer in manners of the complaint will be given in writing. 

4. Having exhausted the complaint procedure, any disputes will be settled by the universal jurisdiction court valid for the for the Organizer. 

5. The Participants' personal data will be processed in accordnance with the principles laid down in the Act on Protection of Personal Data exclusively for the purpose of the Contest, in particular for the need the of choosing the Competition Winners, issuing awards and verifying the veracity of the data. 

6. In matters not covered by these Regulations, the provisions of the Code of Civil Law on Copyright and Related Rights Act and other applicable Polish laws will be taken under final consideration.
